"SERVEOS" refers to the NDIS operational integrity platform and its developer/operator.
"Provider" means the NDIS service provider organisation that has registered for and uses SERVEOS.
"User" means any person who accesses SERVEOS including Provider administrators and support workers.
"Participant" means an NDIS participant whose information is managed through SERVEOS by a Provider.
"Platform" means the SERVEOS software, website, mobile interface and all associated services.
"Data" means all information entered into or generated by SERVEOS including participant records, shift records, and compliance documentation.
To use SERVEOS you must register an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.
You must immediately notify us of any unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account credentials.
You must be at least 18 years of age and have authority to bind your organisation to these Terms to register an account.
One organisation account may have multiple users. Each user is bound by these Terms and the Provider is responsible for ensuring all users comply.
SERVEOS is offered on a subscription basis. Pricing is set out on our pricing page and may be updated with 30 days notice.
All subscriptions include a 14-day free trial. No payment is required during the trial period. After the trial, a valid payment method is required to continue access.
Subscriptions are billed monthly. Payments are processed securely via Stripe. By providing payment details you authorise recurring charges.
Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time from the Billing section of your account.
Refunds: We do not offer refunds for partial months. If you cancel mid-month you will retain access until the end of the billing period.
We reserve the right to suspend access for non-payment after 7 days notice.
As a Provider you agree to:
All data entered into SERVEOS by a Provider remains the property of that Provider. SERVEOS does not claim ownership of any Provider data.
You grant SERVEOS a limited licence to store, process and display your data solely for the purpose of providing the platform service.
SERVEOS acts as a data processor on behalf of the Provider (the data controller) for all participant and worker information. The Provider is responsible for the lawful basis of processing that data.
Upon request, we will provide a Data Processing Agreement (DPA) suitable for your organisation's compliance requirements.
You may export your data at any time from within the platform. Upon account termination, data is retained for 90 days and then permanently deleted.
You must not use SERVEOS to:
We reserve the right to suspend or terminate accounts that violate these terms without refund.
SERVEOS is not liable for:
Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law, including guarantees that cannot be limited for consumers.
We aim to maintain 99.5% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be notified in advance where possible.
We are not liable for service interruptions caused by third-party providers including Supabase, Vercel, or Stripe.
You are responsible for maintaining internet access and compatible devices to use the platform.
SERVEOS and all associated software, designs, trademarks and content are the intellectual property of SERVEOS and its developer. You may not copy, modify, distribute, or reverse engineer any part of the platform.
You retain all intellectual property rights in the data you enter into SERVEOS.
Each party agrees to keep confidential any non-public information received from the other party and to use it only for the purpose of these Terms.
This obligation does not apply to information that is publicly available, required to be disclosed by law, or independently developed without reference to confidential information.
Either party may terminate this agreement at any time. Providers may cancel via the Billing section of their account.
We may terminate or suspend your account immediately if you:
Upon termination, your access to the platform ceases immediately. Data is retained for 90 days then permanently deleted.
These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
We may update these Terms from time to time. Material changes will be notified by email and in-platform notice at least 14 days before taking effect.
Continued use of SERVEOS after the effective date of changes constitutes acceptance of the updated Terms.
