Last updated: 4 May 2026

Please Read Carefully
By accessing or using SERVEOS you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms constitute a legally binding agreement between you (the Provider) and SERVEOS.

1. Definitions

"SERVEOS" refers to the NDIS operational integrity platform and its developer/operator.

"Provider" means the NDIS service provider organisation that has registered for and uses SERVEOS.

"User" means any person who accesses SERVEOS including Provider administrators and support workers.

"Participant" means an NDIS participant whose information is managed through SERVEOS by a Provider.

"Platform" means the SERVEOS software, website, mobile interface and all associated services.

"Data" means all information entered into or generated by SERVEOS including participant records, shift records, and compliance documentation.

2. Account Registration and Access

To use SERVEOS you must register an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your account credentials.

You must immediately notify us of any unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account credentials.

You must be at least 18 years of age and have authority to bind your organisation to these Terms to register an account.

One organisation account may have multiple users. Each user is bound by these Terms and the Provider is responsible for ensuring all users comply.

3. Subscription and Payment

SERVEOS is offered on a subscription basis. Pricing is set out on our pricing page and may be updated with 30 days notice.

All subscriptions include a 14-day free trial. No payment is required during the trial period. After the trial, a valid payment method is required to continue access.

Subscriptions are billed monthly. Payments are processed securely via Stripe. By providing payment details you authorise recurring charges.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel at any time from the Billing section of your account.

Refunds: We do not offer refunds for partial months. If you cancel mid-month you will retain access until the end of the billing period.

We reserve the right to suspend access for non-payment after 7 days notice.

4. Provider Responsibilities

Critical — Please Read
SERVEOS is a software tool. The Provider is solely responsible for ensuring compliance with all NDIS Practice Standards, NDIS Commission requirements, the Privacy Act 1988, and all other applicable laws. SERVEOS does not provide legal, compliance, or professional advice.

As a Provider you agree to:

  • Obtain all necessary consents from participants and workers before entering their information into SERVEOS
  • Ensure all information entered is accurate and lawfully obtained
  • Comply with the NDIS Code of Conduct and all applicable NDIS Practice Standards
  • Maintain your own backup records as required by NDIS rules
  • Not use SERVEOS to store information you are not legally entitled to hold
  • Train your workers in appropriate use of the platform
  • Promptly report any suspected data breaches to us and to the relevant authorities
  • Not share your account credentials with unauthorised persons

5. Data Ownership and Processing

All data entered into SERVEOS by a Provider remains the property of that Provider. SERVEOS does not claim ownership of any Provider data.

You grant SERVEOS a limited licence to store, process and display your data solely for the purpose of providing the platform service.

SERVEOS acts as a data processor on behalf of the Provider (the data controller) for all participant and worker information. The Provider is responsible for the lawful basis of processing that data.

Upon request, we will provide a Data Processing Agreement (DPA) suitable for your organisation's compliance requirements.

You may export your data at any time from within the platform. Upon account termination, data is retained for 90 days and then permanently deleted.

6. Acceptable Use

You must not use SERVEOS to:

  • Store information about persons who have not consented to its collection
  • Falsify shift records, GPS data, or compliance documentation
  • Violate any applicable law or regulation
  • Attempt to gain unauthorised access to other accounts or systems
  • Upload malicious code, viruses, or harmful content
  • Use the platform in any way that could harm NDIS participants
  • Resell or sublicense access to SERVEOS without written permission

We reserve the right to suspend or terminate accounts that violate these terms without refund.

7. Limitation of Liability

Important Limitation
To the maximum extent permitted by Australian law, SERVEOS's total liability for any claim arising from use of the platform is limited to the amount you paid in subscription fees in the 3 months preceding the claim.

SERVEOS is not liable for:

  • Any NDIS compliance failures, audit findings, or regulatory penalties
  • Loss of data due to Provider error or misuse
  • Indirect, consequential, or special damages of any kind
  • Service interruptions due to maintenance, third-party outages, or force majeure events
  • Any harm to participants arising from actions or omissions of the Provider or their workers
  • Inaccurate information entered by the Provider

Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law, including guarantees that cannot be limited for consumers.

8. Service Availability

We aim to maintain 99.5% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be notified in advance where possible.

We are not liable for service interruptions caused by third-party providers including Supabase, Vercel, or Stripe.

You are responsible for maintaining internet access and compatible devices to use the platform.

9. Intellectual Property

SERVEOS and all associated software, designs, trademarks and content are the intellectual property of SERVEOS and its developer. You may not copy, modify, distribute, or reverse engineer any part of the platform.

You retain all intellectual property rights in the data you enter into SERVEOS.

10. Confidentiality

Each party agrees to keep confidential any non-public information received from the other party and to use it only for the purpose of these Terms.

This obligation does not apply to information that is publicly available, required to be disclosed by law, or independently developed without reference to confidential information.

11. Termination

Either party may terminate this agreement at any time. Providers may cancel via the Billing section of their account.

We may terminate or suspend your account immediately if you:

  • Breach these Terms and fail to remedy the breach within 7 days of notice
  • Engage in conduct that we reasonably believe could harm participants
  • Fail to pay subscription fees
  • Provide false information during registration

Upon termination, your access to the platform ceases immediately. Data is retained for 90 days then permanently deleted.
